Education and Knowledge

• Bachelor’s degree in Law.
• Possess high level of legal understanding on power plant operation andmaintenance agreements.
• Possess mastery level of legal knowledge in relation to power generation industry.
• Vast experience in legal areas for operation and maintenance and ability to provide legal advisory and solution.
• Ability to effectively communicate and negotiate with relevant parties on legaladvice note and opinion prepared and issued to them.

Experience Requirements

• Requires a minimum of seven (7) to ten (10) years of legal experience, with at leastfive (5) years in a power industry or other relevant industries.
• Possesses a deep understanding on contract management, with a focus on drafting,negotiating, and administering various contracts relevant to plant operation andmaintenance activities.
• Experienced in handling post-contract issues, dispute resolution and/or cost recoverymatters with suppliers/contractors/OEMs.
• Experience in negotiating contracts with governmental bodies and/or state authoritieswould be an added advantage.
• Willing to travel to power plants across Peninsular Malaysia, as and when required.Demonstrated ability to effectively communicate and influence top management andboard members on complex legal matters.

Accountability & Responsibility

• Execute approved departmental KPIs, ensuring strategic alignment and fostering a culture of continuous improvement.
• Implement, and regularly review the annual operating plan, taking corrective action as needed to ensure alignment with strategic objectives and optimal performance.
• Optimize service delivery by effectively prioritizing and managing legal assignments and requests.
• Provide strategic legal counsel, training, and awareness to TNB Genco management by actively participating in relevant internal committees and task forces.
• Provide strategic legal counsel on asset operation and maintenance activities, specializing in commercial contracts, including power purchase agreements, gas supply agreement, land lease agreement, water royalties, state charges, procurement contracts, insurance claims and long-term service agreements with OEMs.
• Facilitate negotiation for commercial dispute, commercial claim, and arbitration process with relevant parties such as Grid System Operator, Single Buyer, and Energy Commission.
• Oversee the effectiveness of Operation & Maintenance Agreement (OMA) implementation such as TOMA, ROMA, MOMA etc. and take risk mitigation for continuous improvement.
• Oversee the legal approval process for all agreements and provide expert legal opinions and advisory services to TNB Genco and its subsidiaries including drafting and review legal correspondences, agreements as well as legal negotiation.
• Manage all disputes, arbitration and mediation matters involving all TNB Genco assets.
• Build and maintain strategic partnerships with internal and external stakeholders, including government agencies, to advance TNB Genco's objectives.
• Proactively identify, assess, and mitigate legal risks across the organization especially involved plant operation and maintenance activities to avoid any financial losses and potential violations. Develop and implement risk mitigation strategies, ensuring timely communication of critical risks to senior management for informed decision-making.
• Provide expert legal counsel on governance, compliance, and procurement matters to ensure adherence to policies and procedures, thereby maximizing value for TNB Genco.
• Develop strategic ideas and roles by establishing knowledge management framework, talent development plans, career path of legal counsels, succession planning and future direction of Head, TNB GENCO Legal.
• Represent Genco Legal Services in any legal community / association locally and internationally and provide necessary legal views when required.
• Manage and maintain elements of Genco Integrated Management System (ISO 14001, ISO 45001, ISO 55001, ISO 37001, ISO 9001) and other management system standards based on roles and functions as and when required to meet the ISO standard requirements.
